1. Scope of Application

These Terms and Conditions (T&C) govern the use of the website https://doppel.fit/ (hereinafter referred to as "Doppel" or "Platform"), operated by Doppel, hereinafter referred to as "Operator," and apply to all users of the Platform (hereinafter referred to as "Users"), regardless of their location. By accessing or using Doppel, Users agree to be bound by these T&C.

2. Description of the Platform

2.1 Doppel is an information platform that enables Users to browse products listed on third-party Chinese marketplaces and view Quality Control photos provided by shipping agents.

2.2 The Operator does not sell, offer, or provide the products displayed on the Platform. All product listings and related information are sourced from third-party marketplaces and shipping agents. Doppel serves solely as a tool for accessing and presenting this information to an international audience.

3. No Verification or Guarantee

3.1 The Operator does not verify, authenticate, or guarantee the accuracy, authenticity, quality, or legality of any products, listings, or Quality Control photos displayed on the Platform.

3.2 Users acknowledge that the Operator has no control over the products, their availability, or the actions of third-party marketplaces or shipping agents. Any reliance on the information provided on Doppel is at the User's own risk, regardless of the User's location.

4. Affiliate Program

4.1 Doppel offers an affiliate program that allows Users to share products listed on the Platform via a unique referral code ("Ref Code") provided by the Operator.

4.2 When a third party clicks on a User's Ref Code link and subsequently purchases the product from the respective third-party marketplace, there is a chance that either the User's Ref Code or the Operator's Ref Code will be applied to the purchase. This determination is calculated by chance, as decided by the Operator's system.

4.3 Any commissions earned through Ref Codes—whether tied to the User's Ref Code or the Operator's Ref Code—are paid directly by the shipping agents, in accordance with their respective affiliate program terms and conditions.

4.4 The Operator does not facilitate, manage, or guarantee the payment of commissions, nor does it guarantee which Ref Code (User's or Operator's) will be applied to a purchase. Users acknowledge that commission eligibility, amounts, and payment processes are solely governed by the terms of the shipping agents' affiliate programs and are subject to their discretion.

4.5 The Operator is not responsible for any disputes, delays, or non-payment of commissions by shipping agents. Users participate in the affiliate program at their own risk.

4.6 Users agree not to engage in fraudulent activities, such as generating fake clicks or purchases, and acknowledge that such actions may result in exclusion from the affiliate program by either the Operator or the shipping agents.

4.7 The Operator reserves the right to modify or terminate its provision of Ref Codes or the chance-based Ref Code application system at any time without prior notice, though this does not affect the shipping agents' affiliate programs.

5. User Responsibilities

5.1 Users are responsible for their own decisions and actions based on the information provided on the Platform, including participation in the affiliate program.

5.2 Users agree not to misuse the Platform, including but not limited to scraping data, attempting to interfere with its functionality, or using it for unlawful purposes under applicable local or international laws.

6. Intellectual Property

6.1 The content, design, and structure of Doppel, including Ref Codes, are protected by copyright and other intellectual property laws. Users may not reproduce, distribute, or modify any part of the Platform without prior written consent from the Operator.

6.2 Product listings and Quality Control photos remain the property of the respective third-party marketplaces or shipping agents, as applicable.

7. Limitation of Liability

7.1 The Operator provides the Platform "as is" and does not warrant its uninterrupted availability, accuracy, or fitness for a particular purpose.

7.2 To the fullest extent permitted by law, the Operator shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of or inability to use Doppel, including but not limited to losses related to product purchases, reliance on information displayed, or non-payment of affiliate commissions by shipping agents, regardless of the User's jurisdiction.

7.3 Liability is limited to intent and gross negligence, in accordance with German law.

8. Third-Party Links

8.1 Doppel may contain links to third-party websites, such as Chinese marketplaces or shipping agent platforms. The Operator is not responsible for the content, availability, or practices of these external sites, including their affiliate programs.

8.2 Users access third-party websites at their own risk and are subject to the terms and conditions of those sites, which may differ from these T&C.

9. Privacy

The collection and processing of personal data are governed by the Privacy Policy, available on the Platform at https://doppel.fit/privacy-policy, and comply with the General Data Protection Regulation (GDPR) as applicable to an international user base.

10. Changes to the T&C

The Operator reserves the right to modify these T&C at any time. Users will be notified of significant changes via the Platform or by email to [email protected]. Continued use of Doppel after such changes constitutes acceptance of the updated T&C.

11. Governing Law and Jurisdiction

11.1 These T&C are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

11.2 For Users who are merchants, legal entities under public law, or have no general place of jurisdiction in Germany, the exclusive place of jurisdiction for all disputes arising from or in connection with these T&C is Berlin, Germany. For all other Users, statutory jurisdiction rules apply, though German law remains governing.

11.3 Users located outside Germany acknowledge that the Platform is operated from Germany and agree to resolve disputes in accordance with German law, subject to mandatory local consumer protection laws that may apply in their jurisdiction.
